Center, Tx Couple "Kinda" Win Lawsuit for Wrongful Search by Police

Center Police and an estranged couple have reached a settlement agreement in a lawsuit over a wrongful search.

According to federal court records, an agreement was reached in a mediation on July 19.
Marilyn and Stephen Fields sued 11 members of Center Police following a January raid on what ended up being at the wrong home during a service of a search warrant.

According to a complaint filed in federal court by Nacogdoches attorney Curtis Stuckey, Detectives Ricky King, Stephen Stroud, John Welch and Joey Haley, Sgt. Scott Burkhalter, Officers Chris Knowlton, Jeremy Konderla, Steven Thornburgh and David Haley and two unknown Center Police employees raided the home, located on County Road 2231 in Center on Jan. 7.

I really love this part.

 The complaint said the police actually went to the wrong mobile home and would have been at the correct one, had they followed directions on the search warrant.

But in the end they caved for the $$$

"Nobody admitted to liability," said the defendants' attorney, Bob Alderman. "The parties agreed to compromise the suit."

On April 30, Zoning Administrator Kimberley Johnson sent Martha Boneta an official cease-and-desist notice for selling farm products and hosting a birthday party for her best friend's 10-year-old daughter on her 70-acre Paris, Va., farm without a special administrative permit.

US meat producers seek ethanol waiver

The US livestock and poultry industry urged federal regulators to suspend a government mandate for ethanol use for the first time as a severe drought lifts the price of corn feed.

A coalition of beef, pork, chicken and dairy producers said the US Renewable Fuel Standard – which requires billions of gallons of corn-based ethanol to be blended with motor fuel – should be waived “in whole or in substantial part” for 12 months.

The waiver request comes as drought covers nearly all the US corn-growing area and has driven corn prices above $8 a bushel for the first time. Ethanol production and animal feed are the two top uses of the US corn crop, putting refiners and livestock companies in competition for scarce stocks.

“The extraordinary and disastrous circumstances created for livestock and poultry producers by the ongoing drought in the heart of our grain growing regions requires that all relevant measures of relief be explored and taken where possible,” the coalition said in a formal petition to the Environmental Protection Agency.

The US Army has decided to enter the fray and stock up on riot gear too.

Imagine being woke in the middle of sleeping with a phone call like this.

"Your driver was shot in your truck," said the caller, a business colleague. "Your truck was loaded with marijuana. He was shot eight times while sitting in the cab. Do you know anything about your driver hauling marijuana?"
"What did you say?" Patty recalled asking. "Could you please repeat that?"

The DEA seems to think that they can use private property at their convenience, with out the consent of the owner.  Nor do they believe that if something goes wrong, that they have to compensate the owner if that property is damaged.

Commandeered by one of his drivers, who was secretly working with federal agents, the truck had been hauling marijuana from the border as part of an undercover operation. And without Patty's knowledge, the Drug Enforcement Administration was paying his driver, Lawrence Chapa, to use the truck to bust traffickers.

The only humor in this story is that it was such a cluster fuck that that a LEO shot another one.

In the confusion of the attack in northwest Harris County, compounded by officers in the operation not all knowing each other, a Houston policeman shot and wounded a Harris County sheriff's deputy.

But as we know...He didn't build that business.  So why is he crying?
