Franky the drug dog's supersensitive nose is at the heart of a question being put to the U.S. Supreme Court: Does a police dog's sniff outside a house give officers the right to get a search warrant for illegal drugs, or is the sniff an unconstitutional search?

Florida's highest state court has said Franky's ability to detect marijuana growing inside a Miami-area house from outside a closed front door crossed the constitutional line. The state's attorney general wants the Supreme Court to reverse that ruling.

Sources tell Capitol Confidential that the statute creating the CFPB demands that the director be confirmed by the Senate—not installed via recess appointment—to trigger the agency’s shift from Treasury to the Fed and empower the Director.

But none of the legal or constitutional arguments may matter much. Liberals and the Obama administration appear poised to forge ahead with an outrageous and unconstitutional power grab. And by the time the courts work it out, so much damage will already be done.

So, let’s be clear about what is happening here: The President of the United States is planning to use an obscure precedent to claim that a split second in time empowers him to go around Congress to appoint a director to an agency that has broad unchecked, almost dictatorial powers to regulate business in America with little or no oversight from the peoples’ representatives in Congress.

Such actions by the president would be an open declaration of war on constitutional principles and completely undermine our system of checks and balances. These kinds of power grabs are exactly how Banana Republics are born.

Police are taking steps to protect an Albany police officer whose family has received threats after he was publicly identified for using pepper spray to quell Occupy Albany protesters last week.

A "wanted" poster seeking information including the home address, telephone numbers and "map to home" of Officer Richard Gorleski was posted Wednesday on a Facebook page used by Occupy Albany.

Gorleski's address and telephone numbers are not publicly listed. But Gorleski's father, a Troy resident who has the same first name as his son, began receiving unsettling telephone calls from blocked numbers this week.

My five acres is tucked up against the tree line, as you can see plenty of space to camp and meet. I have purchased the first 100 pounds of meet for the BBQ, I will be hitting Sam’s Club today to look for more specials on meat.

I am going to raffle off a Mosin Nagant with ammo, to help pay for the event, the Nagant has never been fired, all serial numbers match and it is still packed in the factory grease from seventy years ago, this is a sweet gun.

Overall attendance is still unknown, I do know we will have at least 30 folks on Saturday the 14th, there are some out of towners that will be arriving on the 12th and 13th. A carving of the Tower of Babel has been found on a stone tablet dating back over 2,500 years.
It comes from the newly published book Cuneiform Royal Inscriptions And Related Texts In The Schøyen Collection. The collection is owned by Norwegian businessman Martin Schøyen, who has amassed over 13,000 ancient manuscripts and tablets.

 Professor Andrew George writes that this drawing is one of ‘the stars in the firmament of the book’.  The depiction of Nebuchadnezzar is one of only four in the world.

Abortion Doctors Charged With Murder

Two out-of-state doctors who traveled to Maryland to perform late-term abortions have been arrested and charged with multiple counts of murder under the state's viable fetus law, authorities said.

The investigation began in August 2010 after a botched procedure at Brigham's Elkton clinic. An 18-year-old woman who was 21 weeks pregnant had her uterus ruptured and her bowel injured, and rather than call 911, Brigham and Riley drove her to a nearby hospital, where both were uncooperative and Brigham refused to give his name, authorities said.

A search of the clinic after the botched abortion revealed a freezer with 35 late-term fetuses inside, including one believed to have been aborted at 36 weeks, authorities said.

I just stopped over at Bare Naked Islam's site and to my delight, found the blog up and running on Wordpress.

Here's the headline that greeted me there:

Bare Naked Islam is back……sort of

WordPress now saying that CAIR had nothing to do with their decision to take down my blog (despite CAIR bragging about it all over the internet). But they still want me off by Jan. 6th.

So what the hell is that? Well, I'll tell you what - I did some digging on Wordpress after this charade was announced since I was a bit more than pissed off and I found that Wordpress is run by a collection of misfits with a corporate name of Automattic - I researched them a little and found their headquarters is in ....wait for it....San Francisco, California. Whoa, there's a big surprise.

The operators of Automattic reads like a Who's Who of tree hugging Leftist Occupying computer geek granola nerds.

Hopefully, we'll find out more of what really happened - if Wordpress is saying that CAIR had nothing to do with it then why was CAIR announcing this to the world before ANYONE knew? Come on Automattic...if they pulled your chain and you caved then at least admit it.

Wordpress isn't off the hook on this. Automattic isn't off the hook on this. And most certainly, CAIR is not off the hook on this.

The Council on American-Islamic Relations (CAIR) announced today that an anti-Muslim Internet hate site that contained a number of threats of violence targeting mosques, including the comment “I want [Muslim] blood on my hands,” has been taken down by its hosting company.

CAIR said visitors to “Bare Naked Islam,” hosted by WordPress.com, now see the message: “barenakedislam.wordpress.com is no longer available. This blog has been archived or suspended for a violation of our Terms of Service.”

Last month, CAIR called on the FBI to investigate the threats of violence targeting mosques posted on the blog and urged WordPress.com to remove it for violating the hosting company’s terms of service (TOS), which prohibit blogs that “contain threats or incite violence towards individuals or entities.” Articles and comments posted on “Bare Naked Islam” urged attacks on and desecration of American and European mosques.

U.S. special operations team was seen crossing the border from Brownsville, Texas into Matamoros, Mexico. Eyewitness reports mention that the U.S. convoy consisted of two or perhaps three SUV’s with what appeared to be armed military personnel on board.

The Mexican military waited on the Matamoros side of the border, and once the U.S. team crossed into Mexico, they escorted them to a nearby military base. The Mexican military and the local police in Matamoros apparently established a route to escort the Americans because traffic cops were placed ahead of time in order to quickly get the convoy through Avenida Sexta (Sixth Avenue).

A helicopter followed the convoy from the U.S. side of the border until it reached the Mexican military base. A video showing the convoy in Matamoros was broadcasted by Univision.

Va. GOP will require loyalty oath in presidential primary

The state Republican Party will require voters to sign a loyalty oath in order to participate in the March 6 presidential primary.

Anyone who wants to vote must sign a form at the polling place pledging to support the eventual Republican nominee for president. Anyone who refuses to sign will be barred from voting in the primary.

After a disastrous holiday shopping season, the parent company of Sears and Kmart will close at least 100 stores to raise cash — a move that sparked speculation about whether the 125-year-old retailer can avoid a death spiral fed by declining sales and deteriorating stores.

Sears Holdings Corp., a pillar of American retailing that famously began with a mail-order catalog in the 1880s, declared Tuesday that it would no longer prop up "marginally performing" locations. The company pledged to refocus its efforts on stores that make money.

Sears' stock quickly plunged, dropping 27 percent.
